General Terms & Conditions (GTC)

1. Scope & Purpose

Avantgarde Vision Luxembourg ASBL (“Avantgarde”) operates a discipline-based digital platform designed to provide visibility, orientation, and access within the creative ecosystem.

Avantgarde provides platform infrastructure only. It does not act as an agency, management, representative, employer, recruiter, or service provider for its users.

 

2. Registration & Membership

Registration on the Avantgarde platform creates a user profile. Visibility on the platform is unconditional and does not require a paid membership.

Paid memberships provide access to additional platform features and functionality but do not imply promotion, representation, selection, or guaranteed outcomes. Avantgarde reserves the right to review, approve, or remove profiles in line with its purpose and these terms.

 

3. Subscription Plans, Billing and Cancellation

This article was added in March 2026 to reflect the introduction of monthly and annual subscription billing options.

 

3.1 Subscription plans

Avantgarde offers paid membership subscriptions for access to enhanced platform features (“Premium Membership”). Premium Memberships are available in the following tiers: Essential, Professional, and Elite. The features included in each tier are described on the AVL pricing page, which may be updated from time to time.

 

3.2 Billing cycles

Members may choose between two billing cycles at the time of subscription:

  • Monthly subscription: the membership fee is charged on a recurring monthly basis, on the same calendar date as the original subscription date (“billing date”).
  • Annual subscription: the membership fee is charged once per year, on the same calendar date as the original subscription date, at a discounted rate as displayed on the pricing page at the time of purchase.

All prices are stated in Euro (€) and are inclusive of any applicable VAT where required by law.

 

3.3 Automatic renewal

Both monthly and annual subscriptions renew automatically at the end of each billing period unless cancelled by the member prior to the renewal date in accordance with Article 3.5. By subscribing, the member expressly authorises Avantgarde to charge the applicable fee to the payment method on file at each renewal.

Avantgarde will send a reminder by email no fewer than 7 days before the renewal of an annual subscription. No separate reminder is sent for monthly renewals.

 

3.4 Price changes

Avantgarde reserves the right to modify subscription prices. Members will be notified of any price change by email at least 30 days before the change takes effect. If a member does not cancel their subscription before the new price takes effect, continued use of the platform constitutes acceptance of the new price.

 

3.5 Cancellation

Members may cancel their subscription at any time through their account settings or by contacting Avantgarde at billing@avantgardevisionlux.lu.

  • Monthly subscriptions: cancellation takes effect at the end of the current monthly billing period. The member retains access to Premium features until that date. No partial refunds are issued for unused days within a billing period.
  • Annual subscriptions: cancellation takes effect at the end of the current annual billing period. The member retains access to Premium features until that date. No partial refunds are issued for the remaining months of the annual period, unless required by applicable law.

Upon cancellation, the member’s account reverts to the free tier and remains accessible in accordance with these General Terms and Conditions.

 

3.6 Right of withdrawal (EU consumers)

For members resident in the European Union, a statutory right of withdrawal of 14 days applies from the date of initial subscription. However, by completing the subscription and accessing Premium features immediately, the member expressly requests that the service commence before the withdrawal period has expired and acknowledges that the right of withdrawal is thereby forfeited upon full performance of the service, in accordance with Article 16(m) of Directive 2011/83/EU.

Avantgarde will present this waiver clearly as a checkbox at the point of purchase.

 

3.7 Failed payments

If a payment fails on the billing date, Avantgarde will attempt to process the charge again within 3 and 7 days respectively. If the payment remains unsuccessful after the second attempt, Avantgarde reserves the right to downgrade the account to the free tier until payment is successfully processed. The member will be notified by email of any failed payment.

 

3.8 Refunds

Subscription fees are generally non-refundable except where required by applicable law or at Avantgarde’s sole discretion in exceptional circumstances. Requests for exceptional refunds may be submitted to billing@avantgardevisionlux.lu.

 

3.9 Switching plans

Members may upgrade or downgrade their subscription tier at any time through their account settings. Upgrades take effect immediately, with the price difference prorated for the remainder of the current billing period. Downgrades take effect at the start of the next billing period.

Switching between monthly and annual billing is possible at the next renewal date.

 

4. AI Features & Data Use

Avantgarde does not use member content, profile data, uploaded media, or any user-generated material to train, fine-tune, or develop artificial intelligence models. Member data is processed solely to operate the platform and deliver its features to the respective user.

Where Avantgarde integrates third-party AI tools to provide platform functionality, those providers are contractually bound by data processing agreements that prohibit the use of user data for AI model training. Avantgarde will identify any such integrations in its third-party processor list and update this policy accordingly.

AI-assisted features on the platform (such as profile assistance or content suggestions) generate outputs based on the member’s own data only. Any AI-generated content remains the full responsibility of the member to review and approve before publication on the platform.

5. No Outcome Guarantees

Avantgarde does not guarantee:

  • professional opportunities
  • collaborations or bookings
  • funding, commissions, or employment
  • visibility results or selection outcomes

All interactions, communications, and outcomes resulting from platform use occur independently between users and third parties.

 

6. Platform Role & Limitation of Liability

Avantgarde provides technical and organisational infrastructure only.

Avantgarde is not responsible for:

  • the accuracy or completeness of user-provided information
  • the conduct of users or third parties
  • agreements, contracts, or communications between users
  • cancellations, changes, or disputes related to published opportunities

To the extent permitted by Luxembourg law, Avantgarde excludes liability for indirect or consequential damages.

 

7. Advisory Board & Ambassadors

Members of the advisory board and ambassadors act in an independent, non-executive, and non-representative capacity.

Their involvement does not constitute:

  • professional advice
  • representation or endorsement
  • responsibility for platform decisions or outcomes

Advisory board members and ambassadors are not liable for actions taken by Avantgarde, its users, or third parties.

 

8. Content & Intellectual Property

Users remain fully responsible for all content they upload or submit.

By submitting content, users confirm that:

  • they hold the necessary rights
  • the content does not infringe third-party rights

Avantgarde may display submitted content within the scope of platform operation.

 

9. Changes, Suspension & Termination

Avantgarde may update platform features, membership structures, or these terms.

Existing memberships will not be reduced in scope without prior notice.

Avantgarde may suspend or remove profiles that violate these terms or conflict with the platform’s non-profit purpose.

 

10. Governing Law & Jurisdiction

These terms are governed by the laws of Luxembourg. The place of jurisdiction is Luxembourg.

 

Community Guidelines (Code of Conduct)

Purpose

Avantgarde is a professional, discipline-based platform designed to enable visibility, orientation, and access within the creative ecosystem. These guidelines exist to ensure a constructive, respectful, and reliable environment for all users.

 

Professional Conduct

Users are expected to:

  • provide accurate and truthful information
  • engage respectfully with other users
  • use the platform for professional and ecosystem-related purposes

Misrepresentation, impersonation, or misleading information is not permitted.

 

Prohibited Use

The following is not permitted:

  • harassment, discrimination, or abusive behaviour
  • unsolicited commercial outreach or spam
  • misuse of profiles or submissions for purposes unrelated to the platform
  • content that infringes third-party rights or applicable laws

 

Content Responsibility

Users remain fully responsible for all content they upload or submit. Avantgarde does not actively moderate content but reserves the right to review and remove content that violates these guidelines or the General Terms & Conditions.

 

Enforcement

Avantgarde may:

  • issue warnings
  • limit functionality
  • suspend or remove profiles

Decisions are made at Avantgarde’s discretion and do not require justification beyond reference to these guidelines and the GTC.

These Community Guidelines form part of the General Terms & Conditions. Violations may result in actions as described in the GTC.

 

Privacy Policy (GDPR)

2. Personal Data Collected

Avantgarde may collect and process:

  • identification and profile data
  • professional information voluntarily provided
  • contact details (for paid members)
  • uploaded media and documents
  • technical data related to platform use
  • payment and billing data processed via our payment provider (Stripe) for paid memberships — Avantgarde does not store full card details; these are held securely by Stripe in accordance with PCI-DSS standards

 

3. Purpose of Processing

Personal data is processed exclusively for:

  • creating and displaying user profiles
  • operating the platform
  • enabling access between users and organisations
  • processing and managing subscription payments and billing
  • administrative and communication purposes

 

4. Visibility & Data Access

Public profile data is visible on the Avantgarde website.

Extended profile data is visible only to:

  • the respective user
  • authorised platform users (e.g. partners or institutions)

Avantgarde does not sell personal data.

 

5. Legal Basis

Data processing is based on:

  • user consent
  • contractual necessity for paid memberships and subscription billing

 

6. Data Retention

Personal data is retained only as long as necessary for platform operation or until deletion is requested, unless legal obligations require otherwise. Billing records may be retained for up to 10 years in accordance with Luxembourg accounting and tax law.

 

7. User Rights

Users have the right to:

  • access their personal data
  • rectify inaccurate data
  • request deletion
  • restrict processing
  • withdraw consent at any time

8. Third-Party Processors

Avantgarde may use technical service providers (e.g. hosting, email services, payment processing via Stripe) in compliance with GDPR. No data is transferred for commercial exploitation.

Where third-party AI tools are used operationally, Avantgarde ensures via data processing agreements that such providers do not use member data for AI model training or development.

 

9. Changes to This Policy

This Privacy Policy may be updated as the platform evolves. The current version is always made available via the Avantgarde website
