General Terms & Conditions (GTC)

1. Scope & Purpose
Avantgarde Vision Luxembourg ASBL (“Avantgarde”) operates a discipline-based digital platform designed to provide visibility, orientation, and access within the creative ecosystem across Europe. Avantgarde provides platform infrastructure only. It does not act as an agency, management company, representative, employer, recruiter, or service provider for its users. Avantgarde does not place, select, or recommend individual members for opportunities. The platform is accessible via web browser and mobile application. These terms apply to all access methods.
2. Registration & Membership
Registration on the Avantgarde platform creates a user profile after approval. Avantgarde applies internal approval criteria to assess applications for profile activation. These criteria are available upon request at hello@avantgarde-eu.com. Basic visibility on the platform is unconditional and does not require a paid membership. The free Basic Profile tier is permanent and has no time limit. Paid memberships provide access to additional platform features and functionality but do not imply promotion, representation, selection, or guaranteed outcomes. Avantgarde reserves the right to review, approve, or remove profiles in line with its purpose and these terms.
3. Membership Tiers
3.1 Talent Tiers
Avantgarde offers the following membership tiers for creative professionals:
– Basic Profile — Free, permanent. Public profile, member dashboard, submit 1 event per month, listed in public calendar, Avantgarde newsletter.
– Community Membership — €89/year or €8.90/month.
– Premium Membership — €149/year or €14.90/month.
– Platinum Membership — €229/year or €22.90/month.
3.2 Ecosystem Organization (ECO) Tiers
ECO tiers are designed for cultural entities that wish to be visible and discoverable within the Avantgarde ecosystem — by talents, peers, and the public. ECO membership is a standalone product separate from Partner accounts.
– Basic Presence — Free, permanent. Public profile card, listed in ecosystem directory, discoverable by talents. No time limit. Supporting the visibility of small organisations with limited resources is central to Avantgarde’s mission.
– Active Member — €150/year or €15/month.
– Ecosystem Partner — €300/year or €30/month
3.3 Partner & Institution Tiers
Partner tiers are designed for cultural institutions and organisations whose primary need is talent discovery — searching the talent pool, building shortlists, publishing calls, and making direct contact. Partner accounts are application-based. Avantgarde does not guarantee outcomes, matches, or responses. Partner accounts do not include a public profile by default. Partners appear on the platform through the opportunities they post. A public ECO-style profile card can be added to any Partner account as a paid add-on (see Article 3.4).
– Access Plus — €1,200/year or €119/month.
– Discovery Premium — €2,400/year or €229/month.
– Discovery Platinum — €4,200/year or €399/month.
3.4 ECO Profile Add-On for Partners
Any Partner tier account may add a public ECO-style profile card for €150/year. This provides a public directory listing linked to the existing Partner account. The ECO add-on and the Partner account are managed from the same dashboard but are billed as separate products.
4. Billing, Payment & Invoicing
4.1 Payment processor
All subscription payments are processed securely via Stripe. Avantgarde does not store full card details. Payment data is held by Stripe in accordance with PCI-DSS standards. By subscribing, members authorize Avantgarde to charge the applicable fee to the payment method on file via Stripe at each billing cycle.
4.2 Billing cycles
Members may choose between two billing cycles at the time of subscription:
– Monthly subscription: the membership fee is charged on a recurring monthly basis, on the same calendar date as the original subscription date.
– Annual subscription: the membership fee is charged once per year on the same calendar date as the original subscription date, at a discounted rate as displayed on the pricing page at the time of purchase.
All prices are stated in Euro (€) and are inclusive of any applicable VAT where required by law.
4.3 Automatic renewal
Both monthly and annual subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date. Avantgarde will send a reminder by email no fewer than 7 days before the renewal of an annual subscription. No separate reminder is sent for monthly renewals.
4.4 Price changes
Avantgarde reserves the right to modify subscription prices. Members will be notified of any price change by email at least 14 days before the change takes effect. Continued use of the platform after the new price takes effect constitutes acceptance of the new price.
4.5 Failed payments
If a payment fails on the billing date, Avantgarde will attempt to process the charge again within 3 and 7 days respectively. If payment remains unsuccessful after the second attempt, Avantgarde reserves the right to downgrade the account to the free tier until payment is successfully processed. The member will be notified by email of any failed payment.
5. Cancellation & Refund Policy
5.1 Cancellation
Members may cancel their subscription at any time through their account settings.
– Monthly subscriptions: cancellation takes effect at the end of the current monthly billing period. The member retains access to paid features until that date.
– Annual subscriptions: cancellation takes effect at the end of the current annual billing period. The member retains access to paid features until that date. Upon cancellation, the member’s account reverts to the free/ downgraded tier and remains accessible in accordance with these terms.
5.2 Refund policy
Subscription fees are generally non-refundable. Avantgarde does not issue partial refunds for unused days within a monthly billing period or unused months within an annual billing period.
Exceptions:
– EU statutory right of withdrawal: for members resident in the European Union, a statutory right of withdrawal of 14 days applies from the date of initial subscription. However, by completing the subscription and accessing paid features immediately, the member expressly requests that the service commence before the withdrawal period expires and acknowledges that the right of withdrawal is thereby forfeited upon full performance of the service, in accordance with Article 16(m) of Directive 2011/83/EU. Avantgarde presents this waiver clearly as a checkbox at the point of purchase.
– Exceptional circumstances: refund requests in exceptional circumstances may be submitted to hello@avantgarde-eu.com and are considered at Avantgarde’s sole discretion.
– Technical failure: if a verified technical failure on Avantgarde’s side prevents a member from accessing paid features for a significant period, Avantgarde will assess the situation and may offer a pro-rated credit or refund at its discretion. A significant period is defined as 30 days or more.
5.3 Switching plans
Members may upgrade or downgrade their subscription tier at any time through their account settings.
– Upgrades take effect immediately, with the price difference prorated for the remainder of the current billing period.
– Downgrades take effect at the start of the next billing period.
– Switching between monthly and annual billing is possible at the next renewal date.
6. Fair Pay Check
The Fair Pay Check is a community-powered, anonymous pay transparency tool available on the Avantgarde platform. It enables members to submit and view aggregated rate information across disciplines, countries, and types of work.
6.1 Data collected
Members may voluntarily submit rate information including: fee range, discipline, country, type of work or engagement. No personal identifiers are collected or linked to submissions. Submissions are anonymous and cannot be traced back to individual members.
6.2 Data use and storage
Submitted data is aggregated and displayed as anonymised community benchmarks. Raw submissions are not shared with third parties. Avantgarde does not sell or commercially exploit Fair Pay Check data. Data is retained in aggregated form to maintain the integrity of benchmarks over time.
6.3 Accuracy and liability
Fair Pay Check data is community-generated and unverified. Avantgarde does not guarantee the accuracy, completeness, or reliability of submitted rates. The Fair Pay Check is an informational tool only and does not constitute professional financial, legal, or contractual advice. Members should use the data as one reference point among many and seek independent advice where appropriate.
6.4 Visibility
Aggregated Fair Pay Check results are visible to all registered members. Submission of data is voluntary and available to Community tier and above. A summary of how Fair Pay Check data is collected and used is also available directly on the Fair Pay Check page within the platform.
7. Events & Formats
Avantgarde may organise, co-organise, or participate in events, exhibitions, fairs, and other formats in which members may be invited to participate (“Events”).
7.1 Participation
Member participation in Events is voluntary and governed by separate participation agreements or terms communicated at the time of invitation. These GTC do not in themselves constitute an agreement to participate in any Event.
7.2 Fees and commissions
Where Events involve fees, booth contributions, or commission arrangements, the applicable terms will be communicated separately and in writing prior to participation. Avantgarde will not charge fees or commissions without prior written agreement with the member.
7.3 Liability
Avantgarde’s liability in connection with Events is limited to its role as organiser or co-organiser of the Event format. Avantgarde is not responsible for outcomes, sales, commissions due from third parties, or arrangements made directly between members and third parties at or arising from Events.
8. AI Features & Data Use
Avantgarde does not use member content, profile data, uploaded media, or any user-generated material to train, fine-tune, or develop artificial intelligence models. Member data is processed solely to operate the platform and deliver its features to the respective user. Where Avantgarde integrates third-party AI tools to provide platform functionality, those providers are contractually bound by data processing agreements that prohibit the use of user data for AI model training. Avantgarde will identify any such integrations in its third-party processor list and update this policy accordingly. AI-assisted features on the platform generate outputs based on the member’s own data only. Any AIgenerated content remains the full responsibility of the member to review and approve before publication on the platform.
9. No Outcome Guarantees
Avantgarde does not guarantee:
– professional opportunities, collaborations, bookings, or engagements
– funding, commissions, or employment
– visibility results or selection outcomes
– responses from institutions or other members
– the accuracy or completeness of Fair Pay Check data
All interactions, communications, and outcomes resulting from platform use occur independently between users and third parties.
10. Platform Role & Limitation of Liability
Avantgarde provides technical and organisational infrastructure only. Avantgarde is not responsible for:
– the accuracy or completeness of user-provided information
– the conduct of users or third parties
– agreements, contracts, or communications between users
– cancellations, changes, or disputes related to published opportunities
To the extent permitted by Luxembourg law, Avantgarde excludes liability for indirect or consequential damages.
11. Advisory Board & Ambassadors
Members of the advisory board and ambassadors act in an independent, non-executive, and nonrepresentative capacity. Their involvement does not constitute professional advice, representation, endorsement, or responsibility for platform decisions or outcomes. Advisory board members and ambassadors are not liable for actions taken by Avantgarde, its users, or third parties.
12. Content & Intellectual Property
Users remain fully responsible for all content they upload or submit. By submitting content, users confirm that they hold the necessary rights and that the content does not infringe third-party rights. Avantgarde may display submitted content within the scope of platform operation.
13. Changes, Suspension & Termination
Avantgarde may update platform features, membership structures, or these terms. Existing memberships will not be reduced in scope without prior notice. Avantgarde may suspend or remove profiles that violate these terms or conflict with the platform’s non-profit purpose.
14. Cross-Border Members & Applicable Law
14.1 Geographic scope
Avantgarde is a European platform open to members and organizations across Europe, including both European Union member states and non-EU countries such as Switzerland, Norway, Iceland, and the United Kingdom. These GTC apply to all members regardless of country of residence.
14.2 EU consumer protection
For members resident in the European Union, the mandatory consumer protection provisions of the member’s country of residence apply to the extent that they provide greater protection than Luxembourg law. These GTC do not limit or exclude any rights that EU consumers are entitled to under the laws of their country of residence. In particular, the EU Consumer Rights Directive (2011/83/EU) and applicable national implementations apply to consumer subscriptions.
14.3 Non-EU members (Switzerland, Norway, and others)
For members resident outside the European Union — including Switzerland, Norway, and other non- EU European countries — these GTC are governed by Luxembourg law. However, mandatory statutory consumer protection provisions of the member’s country of residence are not excluded to the extent they apply under that country’s law. Members in these countries subscribe and pay in accordance with the same terms as EU members, processed via Stripe in accordance with Stripe’s own terms and applicable local regulations.
14.4 Currency and payments
All subscription prices are stated in Euro (EUR). Stripe processes payments from members across Europe and internationally and handles currency conversion where applicable. Avantgarde is not responsible for exchange rate fluctuations or bank charges applied by the member’s financial institution.
14.5 VAT
Avantgarde Vision Luxembourg ASBL is currently below the Luxembourg VAT registration threshold and does not charge VAT on subscriptions. Should VAT become applicable in the future — including upon transfer of commercial operations to a new entity — this will be clearly displayed at the point of purchase. For EU members, VAT rates applicable in their country of residence may apply to digital services in accordance with EU VAT rules. For non-EU members, no EU VAT applies. This section will be updated when Avantgarde’s commercial structure evolves. Members will be notified of any change to VAT treatment with reasonable advance notice.
15. Governing Law & Jurisdiction
These terms are governed by the laws of Luxembourg. The place of jurisdiction is Luxembourg, without prejudice to the mandatory consumer protection provisions applicable in the member’s country of residence as described in Article 14.
